RAMENDRA JAIN, J. (ORAL) Through instant third petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.299 dated 21.10.2018 registered under Sections 279, 337, 308 and 427 IPC at Police Station Division No.6, Ludhiana. According to the prosecution, in the night of 20.10.2018, petitioner while driving his i20 car in high speed hit the police jeep causing damage to it and injured Karanveer Singh, who was standing on the footsteps of the same.
Learned counsel for the petitioner inter alia contends petitioner has falsely been implicated. Petitioner was driving his car at moderate speed, but could not see the barricade due to night hours. No serious injury is suffered by any of the police officials. Petitioner is in custody since RAVINDER SINGH 2018.12.05 15:51 I attest to the accuracy and authenticity of this document 21.10.2018 i.e. more than one month. Filing of final report, framing of
-2CRM-M-52508 of 2018 charge and conclusion of trial may take sufficient long time. No useful purpose would be served by keeping the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
