Through the instant petition, as instituted under Section 439 of the Cr.P.C., the petitioner craves for him being enlarged on regular bail, in case FIR No.405 dated 08.08.2021, under Sections 302/148/149/ 147 of the IPC, and, Section 25 of the Arms Act, registered at P.S. City Hisar, District Hisar.

After addressing arguments for some time, when this Court was not inclined to grant the relief of regular bail to the petitioner, the learned counsel for the petitioner seeks leave to withdraw the instant petition, however, since the petitioner has suffered incarceration of approx. 03 years and the trial has reached only midway, therefore, he also makes a request for issuance of directions upon the learned trial Court concerned to expeditiously conclude the trial. 3.

Considering the innocuous and bona fide prayer made by the learned counsel for the petitioner, the instant petition is dismissed as withdrawn, but, with a direction to the learned trial Court concerned to DEVINDER YADAV 2024.09.11 14:45 I attest to the accuracy and authenticity of this order/judgment

CRM-M-25997-2024 make all efforts to, within six months from today, complete the recording of prosecution evidence. Moreover, the S.P. concerned is also directed to ensure the presence of all remaining prosecution witnesses, on each and every date, as fixed by the learned trial Court concerned, for their examination.

A copy of this order be forthwith sent to the learned trial Court concerned, and, to the S.P. concerned for information and compliance.
