(ORAL) The petitioner has approached this Court for issuance of a writ in the nature of certiorari, inter alia, seeking quashing of an order dated 03.03.2017 (Annexure P-14) with all consequential benefits, including refund of Rs.5,12,898/- along with interest in view of the judgment dated 13.12.2019 rendered by this Court in case titled as "Deenu Khan v. State of Haryana and others".

Learned counsel for the petitioner submits that impugned order is totally illegal as petitioner never intended to give undue benefit to Shri Deenu Khan and she signed the pension papers in routine being DDO. He further submits that an appeal filed against the impugned order- P/14 has not been decided yet despite having been file way back in year 2016. 3.

In view of the pendency of appeal filed by petitioner, availing his statutory alternative remedy, no ground for interference by this Court is made out at this stage.

However, since the appeal has already been pending adjudication for more than 05 years, instant petition is disposed with the expectation that the Appellate Authority shall decide the appeal on priority, within a reasonable period, subject of course, to all pandemic precautions.
