The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondents to permit it to operate its rice mill.

Mr. Inderpreet Singh Kang, Advocate inter alia contends that petitioner has been declared defaulter on account of non-supply of rice against paddy which it received during crop year 2020-21. It has settled all its disputes with the bank and wants to settle dues with the respondents as well. It is willing to deposit 10% of the disputed amount and thereafter as soon as revenue would generate.

Mr. Aman Sharma, Advocate submits that on the asking of respondents, an Arbitrator has already been appointed who is seized of the matter. The petitioner should approach the Arbitrator for the relief sought. 6.
Faced with this, Mr. Inderpreet Singh Kang, Advocate seeks permission to withdraw the instant petition with liberty to approach Arbitrator for the relief sought, as well as pursue his representation pending with respondent.
