RAMENDRA JAIN , J. (ORAL ) Through this petition under Section 439 Cr.P.C., petitioner-Vikram Singh @ Vicky, has prayed for grant of regular bail in case FIR No.0139 dated 31.05.2018, registered under Sections 392 and 397 IPC and Section 25 of the Arms Act, at Police Station Narwana City, District Jind.

` According to the prosecution, in the morning of 31.05.018, three unknown persons intercepted the Scooty of complainant and on pistol point, they snatched the same and ran away along with Scooty. CRM-M-24029-2019 support the prosecution story. Copy of statement of complainant is annexed as Annexure P-2. Petitioner is in custody since 20.6.2018. Counsel for the petitioner further states that co-accused of the petitioner namely Ajay has been granted the concession of regular bail vide order dated 27.5.2019, passed by this Court in CRM-M-23418-2019, therefore, treating the case of the petitioner on parity, he also deserves to be enlarged on regular bail. Conclusion of trial may take a long time, as on date, only three prosecution witnesses are stated to have been examined. No useful purpose would be served by detaining him in jail.

On the other had, learned State counsel though vehemently opposed the submissions of learned counsel for the petitioner but has admitted that the co-accused of the petitioner has been granted the concession of regular bail.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, on the principle of parity, the petition is allowed. Consequently, petitioner Vikram Singh @ Vicky, is ordered to be released on bail pending trial, if not required in any other case, on his furnishing adequate bail bond and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
