Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.174 dated 30.10.2018 under Sections 420, 406 IPC and Section 13 of the Travelling Professional Regulation Act, registered at Police Station Goraya, District Jalandhar. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. As per prosecution version, allegation against the petitioner is VINEET GULATI 2019.04.11 14:30 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-52675 of 2018 -2that she cheated the complainant to the tune of `15 lakhs by making false promise to send son of the complainant namely Manav Kumar to Canada. Learned counsel for the petitioner relied upon the agreement, copy of which is placed on record as Annexure P-4, in which it is stated that Vimal Verma and Manav Kumar entered into agreement for supply of electronic goods for sale in Punjab and Manav Kumar has been introduced by Balwinder Kaur @ Poonam.

The petitioner has already joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending and keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 01.12.2018 granting interim bail to the petitioner, is made absolute.
