**** RITU BAHRI , J. (Oral) Petitioner is seeking quashing of final selection list dated 03.03.2019 (P-5), as the name of the petitioner was not included inspite of having higher marks than the last candidate i.e 24 marks in ESM category. Issue notice of motion.

On asking of the Court, Ms. Palika Monga, DAG Haryana accepts notice on behalf of the State. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself. Learned State counsel states that the petitioner is dependent of Ex servicemen and he will only have a right for appointment if suitable ex servicemen are not available.

The writ petition is dismissed as even the petitioner is having higher marks than the last candidate, he has no right of appointment, as he is dependent of Ex servicemen.
