(ORAL) Counsel for the petitioner contends that the medical reimbursement bills, which the petitioner had submitted for the period from 21.09.2015 till 29.09.2015 in respect of the treatment undertaken by his wife and daughter, who had met with an accident, are not being released on the ground that petitioner was working on contract basis on the said date.

Counsel for the petitioner argues that vide order dated 15.12.2016, the services of the petitioner were regularized w.e.f. 15.02.2012 and therefore, on the date of the treatment, which was in September, 2015, the petitioner is to be treated as a regular employee for all intents and purposes and is entitled for the reimbursement of the medical bills.

CWP-14434-2019 -2Counsel for the petitioner states that for the relief, which has been sought in the present writ petition, petitioner has submitted a representation dated 07.01.2019 (Annexure P-9) to the respondents, which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 07.01.2019 (Annexure P-9) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
