(ORAL) Counsel for the petitioner argues that even where a charge sheet is pending, the pension and other benefits except gratuity and leave encashment cannot be withheld keeping in view the judgment of the Full Bench of this Court in Punjab State Civil Supplies Corporation Limited Vs. Pyare Lal, 2015(1) PLR 617.

Counsel for the petitioner further argues that in the present case, except GPF no other benefits such as pension etc. has been released to the petitioner, which action of the respondents is arbitrary. Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has submitted the representation dated 12.01.2019 (Annexure P-3) to the respondents, which is still pending consideration with the respondents and the NARESH KUMAR 2019.05.28 15:16 I attest to the accuracy and integrity of this document Chandigarh

CWP-14117-2019 -2petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation keeping in view the settled principle of law.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 12.01.2019 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
