(ORAL) Challenging the order of release of vehicle on Superdari , the petitioner-UOI has come up before this Court on the ground that the contraband recovered from the said vehicle was huge.
Learned counsel for the petitioner-Union of India submits that vehicle in question should not be returned because there is possibility of its being reused by the owner of the vehicle in crime.
The value of the vehicle would go down every passing day and so would go its model and monetary value. The carbon emissions while manufacturing the vehicle, the human resources involved in its production and all the efforts made to ply the same on the road would also go waste in case it is not run. To take care of its being misused, the owner of the vehicle shall install a GPS in the vehicle and supply its location with the concerned investigator.
Learned counsel for the respondent submits that the vehicle was already released to the wife of the accused from whom the contraband was allegedly recovered. Now only what is remaining in such release order is that in the said vehicle, wife of the respondent shall install a GPS and share its location with the investigating officer. The installation must be done within 30 days from today. Given above, no further order is required to be passed in this petition. The present petition is disposed of. All pending applications, if any, stand disposed of.
