The instant petition has been filed under Section 482 Cr.PC for setting aside the order dated 25.04.2019 (Annexure P-4) whereby the application under Section 311 Cr.PC was dismissed by the learned trial Court in case FIR No.268 dated 10.12.2017 registered under Sections 279/304-A, 427 IPC at Police Station Phillaur, District Jalandhar. 2.

Learned counsel for the petitioner contends that due to inadvertence the defence omitted to confront the complainant Lakhveer Singh on certain material facts in respect to the medical treatment given to the deceased and also with respect to his statement Ex.PA made by him to the police, during his cross-examination.

I have perused the examination-in-chief as well as the crossexamination of the complainant by the defence, which has been annexed as Annexure P-1/A. A perusal of the same, rather, reveals that the complainant has, in fact, been cross-examined extensively on all material aspects of the case regarding the occurrence.

In this view of the matter, I do not find any ground to interfere in the impugned order dated 25.04.2019 (Annexure P-4). 5.
