JUSTICE TRIBHUVAN DAHIYA Present:- Mr. Nitin Rathee, Advocate for the petitioner Mr. Harish Rathee, Sr. DAG, Haryana *** TRIBHUVAN DAHIYA, J. (Oral) The petition has been filed seeking a writ of mandamus directing the respondents to grant full pension to the petitioner along with retiral benefits, instead of the proportionate pension given to her at the time of retirement. 2.
Learned counsel contends that the petitioner retired from service on 30.11.2008 after rendering twenty-eight years one month and twelve days of service, and based upon that she was released proportionate pension. She is entitled to full pension and retiral benefits on the basis of notification dated 17.04.2009, which is applicable to all those employees who retired from service after 01.01.2006, that is, whether prior to or after the notification. It has been so held by the Full Bench, vide judgment dated 19.07.2024, passed in CWP No.17310 of 2015 titled Shamsher Singh and others v. State of Haryana and others.
