*** It is a case of version and cross version of the incident. The F.I.R. in this case was lodged on the basis of statement of Tejinder Singh, whereas he along with his brother Palwinder Singh are accused in the cross version. The incident is said to have taken place outside the shop of present petitioners. Two persons from their side had suffered injuries in the incident. They are stated to have joined the investigation and recovery has been effected from them. Tejinder Singh has submitted an affidavit that he does not hold any Passport whereas Palwinder Singh has submitted his Passport to the investigating officer.

CRM-M No. 6645 of 2017 Under such circumstances, the interim bail granted to the petitioners on 1.3.2017 is made absolute, subject to their fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.
