CORAM:

HON'BLE MS. JUSTICE RITU BAHRI

Present:

Mr. H.S. Brar, Advocate for the petitioners.

**** RITU BAHRI , J. (Oral) Prayer in this petition is for quashing of F.I.R No. 73 dated 07.07.2015 under Sections 406/498-A/34 IPC, registered at P.S Gidderabaha, District Sri Muktsar Sahib.

Learned counsel submits that petitioner is mother-in-law and brotherin-law of the complainant. The son of the petitioner married with the complainant on 08.11.2012 and son of petitioner No. 1 is working in Kapurthala and the petitioners never cohabited with the complainant. After investigation, challan was presented against son of petitioner No. 1 and petitioners. After arguing for some time, learned counsel for the petitioners wishes to withdraw the petitioner with a liberty to take all the pleas before the trial Court.

Dismissed as withdrawn with the aforesaid liberty. Keeping in view the above fact that the allegations levelled against the present petitioners are general in nature, the personal appearance of the petitioners is exempting before the trial Court, subject to the following conditions:- (i) petitioners shall be represented through counsel; (ii) shall not delay/stall the trial proceedings; (iii) shall not dispute their identity as an accused: (iv) shall have no objection if the prosecution evidence is recorded in their absence but in the presence of their counsel; (v) shall appear before the trial Court as and when required by the trial Court; and (vi) any other condition which the learned trial Court may impose.
