Prayer made in the present petition is for grant of higher grade to the petitioner w.e.f. January, 2002 instead of 25.05.2004 by making reference to respondent No.4, who was granted the same. 2.

Learned State counsel, on the other hand, refers to para 3 of the counter affidavit dated 21.09.2011 filed by President, District Consumer Disputes Redressal Forum, Sangrur, to which there was no counter filed, wherein it has been stated that the petitioner was appointed as Clerk in the year 1997 whereas respondent No.4 in the year 1995, regarding which seniority list was circulated on 02.09.2005, however no objection thereto was filed by him and it came to be finalized on 31.10.2005. Accordingly, respondent No.4 was placed as Junior Assistant w.e.f. 03.11.2000 and the representation filed by the petitioner was barred by time having been submitted around four and half years thereafter and also estopped to raise the issue by the principle of estoppel and acquiescence. 3.
