Versus

State of Punjab and others ...... RESPONDENT (s) CORAM:- HON'BLE MRS.JUSTICE LISA GILL

Present:

Mr. Rajesh Bhatheja, Advocate for the petitioner.

***** LISA GILL, J.

Prayer in this petition is for issuance of directions to respondents No.2 to 3 for protecting the life and liberty of the petitioner and her family members at the hands of respondents No.4 to 8. It is contended that due to a matrimonial dispute between the petitioner and her husband i.e. respondent No.2, the petitioner was turned out of her matrimonial home. She is residing at her parental home. It is further contended that respondents No.5 to 7 trespassed into her parental home on 28.01.2017. Injuries were caused to the petitioner. Reference is made to Medico Legal Report (Annexure P1). The petitioner complained before the Station House Officer, Police Station City Moga on 05.02.2017. However, no action was taken. A complaint under Sections 307/323/406/452/148/149 IPC was filed by the petitioner before the learned Chief Judicial Magistrate, Moga. CRM No.M-6726 of 2017 [2] It is contended that subsequent to the filing of this complaint, respondents No.4 to 8 are threatening the petitioner to withdraw the said complaint. In this respect, a representation (Annexure P3) dated 20.02.2017 has been submitted by the petitioner before respondent No.2 i.e., the Senior Superintendent of Police, Moga. However, no action is being taken.

Having heard learned counsel for the petitioner and going through the petition but without commenting on the merit of the case, it is considered just and expedient at this stage to dispose of this petition with a direction to respondent No.2 - Senior Superintendent of Police, Moga to look into the representation/complaint dated 20.02.2017 submitted by the petitioner and take necessary action, if any is called for, in accordance with law.
