Petitioner seeks concession of pre-arrest bail in a case registered against him under section 380/34 IPC vide FIR No. 281 dated 28.12.2017 at police station Division No. 7, Jalandhar. It has been urged before the court that petitioner has not committed any offence as alleged. He has been falsely implicated in the present case. Thus, he deserves the concession of pre-arrest bail.
FIR was lodged on the basis of complaint lodged by Sandeep Kumar, who was running a jewelry shop in Ghara Road, Near Daya Nand Chowk for the last ten year. He alleged that on 28.12.2017 at about 2.10 p.m. when he was present at his shop, one young man wearing a cap came to his shop to purchase gold jewelry. On his request, complainant showed him 6 to 7 gold chains in a tray. Thereafter, he asked the complainant to show a gold kara's also. As the complainant turned back, at that time he deliberately picked one gold chain from the tray and fled from the scene of occurrence. On registration of FIR, investigation ensued. CRM M-5280 of 2018 confessional statement was recorded by the investigating agency on 07.01.2018. Same implicates the petitioner. Moreover, in the CCTV footage also both the accused were present at the place of occurrence at the relevant time.
Keeping in view entire facts and circumstances of the case, I am of the considered view that petitioner is not entitled to concession of prearrest bail. Petition is, thus, without any merit and is hereby dismissed. February 15, 2018 (RAJAN GUPTA) Ajay JUDGE Whether speaking/reasoned:
