Petitioner No.1- Aarti, aged 25 years and petitioner No.2Rajesh, aged 39 years, have filed second instant petition for seeking directions for protection of their lives and liberty, which is at danger at the hands of respondent No.4-Sukhai, who is related as uncle of petitioner No.1. 2.

First protection petition i.e. CRWP-4394-2023 was withdrawn by the petitioners vide order dated 08.05.2023, with liberty to file again with correct & complete particulars.

Learned counsel for the petitioners submits that petitioner No.1 - Aarti, aged 25 years and petitioner No.2 - Rajesh, aged 39 years have solemnized marriage on 26.04.2023, against the wishes of their family members, arrayed as respondent No.4. Counsel for the petitioners submits that said marriage certificate has been signed by Simran Kaur and Sunita,who are stated to be relatives of petitioner No.1-Aarti and also staying at Ambala (Hry.). It has been submitted that the private respondent is threatening to interfere in the matrimonial life of the petitioners. Hence, the petitioners are seeking protection in that regard and have approached this Court by way of KAVITA NAIN 2023.05.25 16:46 I attest to the accuracy and integrity of this document order/judgment

2023:PHHC:075864 CRWP-5047-2023 - 2 - filing the instant petition. They have also submitted a representation dated 01.05.2023 (Annexure P-4), to respondent No.2 - Superintendent of Police, Police Line, Ambala City, wherein, they have expressed their apprehension. 4.

Notice of motion.

On asking of the Court, Mr. Vikas Bhardwaj, AAG, Haryana, accepts notice on behalf of respondent No.1 to 3 (State). 6.

In view of the above, the present petition is disposed of with a direction to respondent No.2 - Superintendent of Police, Police Line, Ambala City, to look into the representation dated 01.05.2023 (Annexure P4), qua threat perception, and if there is any substance in it, take necessary steps, in accordance with law, to ensure that the lives and liberty of the petitioners are not jeopardized at the hands of the private respondent. 7.

However, this direction will not validate the marriage said to have taken place between the parties and will have no effect on any civil or criminal action, which could be initiated in the matter in accordance with law.
