Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned order dated 11.02.2026 (Annexure P-3) passed by respondent No.2. Further a writ of mandamus has been sought, directing the respondents not to recover the alleged amount as per the impugned order dated 11.02.2018 (Annexure P-3) from the dues of the petitioner and his pension and to refund the amount of leave encashment and gratuity.

At the outset, learned counsel for the petitioner confines his prayer to a limited extent and submits that a direction be issued to respondent No.1 to decide the statutory appeal dated 20.03.2026 (Annexure P-4), which is stated to be pending consideration. He further submits that recovery is being effected from the pension of the MOHD YAKUB 2026.04.27 16:40 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.

CWP-12331-2026 petitioner and the petitioner would be satisfied if a direction is issued to respondent No.1 to hear and decide the aforesaid appeal by passing a speaking order within a stipulated time. He further prays that recovery from the petitioner's pension be stayed till the final adjudication of the said appeal.

Mr. Prince Singh, Advocate, accepts notice on behalf of the respondents and submits that he has no objection, in case a direction is issued to respondent No.1 to hear and decide the statutory appeal dated 20.03.2026 (Annexure P-4), in a time bound manner. 5.

In view of the limited prayer made by learned counsel for the petitioner, without commenting upon merits of the case, the present petition is disposed of and respondent No.1 is directed to hear and decide the statutory appeal dated 20.03.2026 (Annexure P-4) in a time bound manner and pass a speaking order, within a period of four months from the date of receipt of certified copy of this order. 6.
