(O&M) Claimants are aggrieved of order dated 13.09.2006 passed by Commissioner, Sonipat under the Workmen's Compensation Act, 1923. The grievance raised is with respect to denial of interest and penalty in terms of Section 4A of the 1923 Act. Having heard learned counsel for the parties and after carefully going through records of the case, this Court finds that the Commissioner erred in denying penalty amount to the claimants. (O&M) the compensation amount of Rs.2,54,160/-. The same shall be payable by the employer i.e. respondents No.1 to 3. The interest awarded also needs to be modified. Claimants are also entitled to interest @12% per annum for the period commencing from 30 days after the date of accident till the date of actual realization.
