(Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.34 dated 11.2.2022 registered under Section 379-B(2) at Police Station Sadar District Amritsar (City). The counsel for the petitioner submits that FIR in this case was registered against unknown persons and the petitioner is behind the bars since last more than 8 months and that complainant Rekha has already been examined and it will take time for the trial to conclude and as such no fruitful purpose will be served by prolonging the judicial custody of the petitioner.

( 2 ) CRM-M-27535-2022 (O&M) The State counsel on instructions from ASI Pargat Singh has not disputed that FIR in this case was registered against some unknown persons for snatching gold tops of complainant-Rekha. I have considered the submissions made by counsel for the parties.

Admittedly the FIR in this case was got registered by complainant-Rekha against unknown persons, who snatched her gold tops on 10.2.2022. The petitioner was arrested in this case and as per custody certificate he is languishing behind bars since last more than 8 months. As per the copy of order dated 16.9.2022 which has been supplied by the counsel for the petitioner, the complainant has been examined in this case. So there is no apprehension that if the petitioner is released on bail, he is going to influence the witnesses. It will take considerable time for the trial to conclude. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
