***** HARNARESH SINGH GILL, J. (ORAL) Case is taken up for hearing through video conferencing. The reply/status report by way of affidavit dated 19.10.2021 of the Deputy Superintendent of Police, Dabwali, already filed in the Registry, is taken on record.

Through this petition, the petitioner seeks regular bail in case bearing FIR No.229 dated 01.08.2020, registered under Section 379-A IPC, at Police Station Civil Lines, District Sirsa.

Learned counsel for the petitioner states that petitioner has been falsely implicated in the present case on the basis of the disclosure statement of co-accused Sikander Singh @ Goru, who has already been granted regular bail by this Court vide order dated 08.07.2021. The petitioner is in custody since 04.08.2020. Prosecution witnesses are yet to be examined. Learned State counsel while opposing the prayer of the petitioner for grant of bail, has stated that the petitioner alongwith co-accused Sikander Singh @ Goru has been seen in the CCTV footage.

Recovery has already been effected from the petitioner. He further states that out of ten prosecution witnesses, one has already been examined. I have heard the learned counsel for the parties. In the present case, the petitioner is implicated on the basis of the disclosure statement of the co-accused, who has already been granted regular bail vide order dated 08.07.2021 passed by this Court. Nine prosecution witnesses are yet to be examined. Petitioner has been in custody since 04.08.2020. No other case is pending or registered against the petitioner. The trial is unlikely to conclude any time soon. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.

In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
