Instant petition has been filed under Section 482 of the Code of Criminal Procedure for setting aside the order dated 05.07.2019 (Annexure P-3) whereby the petitioner has been declared as Proclaimed Offender in FIR No.61 dated 26.05.2018 registered under Sections 20 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Badhni Kalan, District Moga.

In pursuance to the order dated 14.10.2020, the petitioner has surrendered before the trial Court and has been released on regular bail, vide order dated 06.11.2020, which has been sent by the counsel for the petitioner by e-mail and its print out has been taken on record. CRM-M-25433 of 2020 {2} The purpose of initiating proceedings under Section 82 Cr.P.C is to secure the presence of the accused. Once the accused, who was absconding, has surrendered and obtained bail, the objective stands achieved and the accused can no longer be described as an absconder. Since the petitioner has already joined the proceedings, the impugned order dated 05.07.2019 (Annexure P-3) is set aside, insofar as the petitioner has been declared as Proclaimed Offender.

The petition is disposed of.
