The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to fix the pay of the petitioner as per recommendations of 6th Punjab Pay Commission as per Notification dated 05.07.2021 (Annexure P-2); to grant him the annual grade increments for the period from December 2019 to December 2025; to release his salary for the period from June 2024 to December 2025; to grant him the benefit of 14 years additional increment/higher pay-scale under ACP Scheme in view of Punjab Government Policy dated 03.11.2006 (Annexure P-3) and to give him the consequent arrears of the aforesaid benefits along with interest @ 12% per annum. 2.

Learned counsel for the petitioner submits that for redressal of his grievances, the petitioner has also served legal notice dated 03.02.2026 (Annexure P-4) to the respondents which is still pending consideration. Mr. Swapan Shorey, D.A.G., Punjab, accepts notice on behalf of the respondents-State. He has no objection to the innocuous prayer made by learned counsel for the petitioner. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider and decide legal notice dated 03.02.2026 (Annexure P-4) submitted by the petitioner expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioner, preferably within a period of 03 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted to him within a period of 01 month thereafter.
