ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.66 dated 19.10.2015 registered under Sections 323, 148, 149 IPC and 25/27/54/59 of the Arms Act at Police Station Ragar Nangal, Police District Batala, District Gurdaspur.
Counsel for the petitioner submits that the petitioner, in pursuance to the order dated 19.01.2018, has already appeared before the Investigating Officer and has joined the investigation. It is further submitted that the petitioner is not holding any licensed weapon. Counsel for the State, on instructions from ASI Darshan Singh, has not disputed the factual position and submits that the petitioner is no more required for any further investigation. It is further submitted that neither the petitioner nor his father is holding a licensed weapon.
In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 19.01.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
