(Oral) This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to release the pension and pensionary benefits including gratuity, leave encashment, GPF Fund, arrear of pension etc. to the petitioner on account of death of his father, who was working as Peon in the Department. He claims to be the legally adopted son and entitled to the said benefits under the Rules.

Learned State counsel, on instructions, submits that the due benefits in accordance with the rules will be released to the petitioner on his submitting the succession certificate issued to him under Section 372 of the Indian Succession Act, 1925.

Learned counsel for the petitioner submits that the certificate will be submitted to respondent No.2/Director Secondary Education, Haryana, within four weeks.

In case the succession certificate is submitted by the petitioner within four weeks, all due retiral benefits in accordance with the rules shall be released to him by the respondents within a period of six weeks therefrom. 5.
