NIDHI GUPTA, J. (ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 32 dated 17.03.2022 registered under Sections 363, 366-A and 376 IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Subhanpur, District Kapurthala. At the outset, learned counsel for the petitioner submits that the present petition has been rendered infructuous and may be disposed of as such, as the petitioner has already been acquitted by the leaned Judge, Special Court, Kapurthala vide judgment dated 27.07.2023 in Case No. SC/93/2022 titled as 'State of Punjab vs. Harwinder Singh @ Gopi @ Amrit'.
Learned counsel for the State has filed custody certificate dated 12.10.2023, in which too it is mentioned that the petitioner has RISHU KATARIA 2023.10.17 11:22 I attest to the accuracy and authenticity of this order/judgment
