Criminal Misc. No. M-47738 of 2018 -2CORAM:- HON'BLE MR. JUSTICE HARI PAL VERMA Present:- Mr. S.P. Soi, Advoate for the petitioner(s).

Mr. Saurav Khurana, DAG, Punjab.

***** HARI PAL VERMA, J. (Oral) This order shall dispose four cases i.e. Criminal Misc. Nos.M46601, 47738, 50821 and 52959 of 2018, as similar prayer has been made in all the petitions seeking quashing of common FIR i.e. FIR No.29 dated 4.2.2018 under Section 498A IPC and Sections 420, 375/4/120-B IPC (added later on) registered at PS Adampur, District Jalandhar. However, for brevity, facts have been noticed from Criminal Misc. No.M-52959 of 2018.

Learned counsel for the petitioners states that after filing these petitions, seeking quashing of the FIR, on merits, a compromise has arrived at between the parties and consequently, a separate petition i.e. CRM-M15329-2019 Dev Raj & ors. Vs. State of Punjab & anr., seeking quashing of FIR in question, on the basis of compromise, has been filed, which is now listed for hearing on 04.12.2019. He further states that the petitionerhusband had also filed a petition under Section 9 of the Hindu Marriage Act, wherein the complainant-wife has not contested the said petition and resultantly, a decree of restitution of conjugal rights has been passed against the complainant-wife on 19.05.2014.

In the background of the submissions made above, learned counsel for the petitioners states that at this stage, he seeks withdrawal of

Criminal Misc. No. M-47738 of 2018 -3these petitions, as a separate petition for quashing of FIR on the basis of compromise is already pending consideration.

Dismissed as withdrawn.

Photocopy of this order be attached in the file of each connected case.
