**** RAJ MOHAN SINGH, J.(Oral) The present petition has been preferred by the petitioner for issuance of an appropriate writ, order or direction, especially in the name of quo-warranto for removal of respondent No.5 from the post of Sub Registrar as his initial appointment on the post of Kanungo on compassionate ground was fraudulent.

Learned counsel for respondent No.5 submits that respondent No.5 stands superannuated on 30.09.2021 from the post of Sub Registrar, which is a promotional post. Initial appointment of the petitioner was on the post of Kanungo on PRINCE SAINI 2021.11.23 13:01 I attest to the accuracy and integrity of this document

CWP No.14460 of 2021(O&M)  compassionate ground in the year 1990. Respondent No.5 was promoted to different posts from time to time and the department did not initiate any proceeding in Court of law. The enquiry was conducted against the petitioner on 25.11.2019 and on the basis of said enquiry, respondent No.5 has already been charge-sheeted on 05.01.2021 and facing the departmental action under Rule 8 Volume II of Punjab CSR.

Since respondent No.5 has already been superannuated, therefore, nothing survives in this petition, however, law will take its own course in respect of pending charge-sheet against respondent No.5. This Court has no doubt that the department shall act in accordance with law at the earliest.

Disposed of.
