RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerBanti Rajput, has prayed for grant of regular bail in case FIR No. 128 dated 21.08.2018 registered under Section 22 of the NDPS Act at Police Station Urban Estate, Patiala.
According to the prosecution, on 21.08.2018, the petitioner was apprehended with 380 intoxicant tablets, without any permit or licence, to keep the same.
Learned counsel for the petitioner inter alia contends that the alleged recovery of tablets from the petitioner falls under the definition of 'non-commercial quantity'. The petitioner is in custody since 21.08.2018. Conclusion of trial may take long time. No useful purpose would be served by detaining the petitioner in jail.
