This order shall dispose of present petition for grant of anticipatory bail filed by the petitioner, an accused in case FIR No.12 dated 24.01.2025 under Sections 115(2), 118(1), 118(2),126(1), 351(3),191(3), 190 of BNS registered at P.S Samrala, District Ludhiana.

Learned State counsel, on instructions from ASI Balkar Singh, submits that the petitioner has joined the investigation though he has not fully cooperated with the Investigating Officer. He has not disclosed about the whereabouts of other accused.

This fact is refuted by learned counsel for the petitioner, who states that after joining the investigation, recovery of the weapon allegedly used by the petitioner was also got effected. Learned counsel thus submits that the presence of the petitioner is not needed for custodial interrogation and thus, the concession of interim anticipatory bail granted earlier to the petitioner be confirmed. 5.
On 01.05.2025, following order was passed by this Court: "Petitioner is seeking the concession of anticipatory bail in FIR No.12 dated 24.01.2025 under Sections 115(2), 118(1), 118(2), MANOJ KUMAR 2025.10.01 04:01 I attest to the accuracy and authenticity of this order
CRM-M-23049-2025 126(1), 351(3), 191(3), 190 of the BNS, registered at Police Station Samrala, District Ludhiana.
Learned counsel for the petitioner, inter alia, contends that although the petitioner has been named in the FIR in question, however, the petitioner has only been attributed a simple injury with a stick on the back of the head of the complainant. Notice of motion.
On the asking of the Court, Mr. H.S. Deol, Senior Deputy Advocate General, Punjab, accepts notice on behalf of the respondent.
Adjourned to 13.08.2025.
Meanwhile, the petitioner is directed to join the investigation and appear before the investigating agency as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) BNSS/438(2) Cr.P.C."

Keeping in view the above submissions advanced by learned counsel for the petitioner as also the fact that the petitioner has joined the investigation, interim bail granted vide order dated 01.05.2025 is hereby confirmed, subject to conditions as envisaged under Section 482(2) BNSS. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court. 7.
The petition stands allowed.
