Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in complaint case baring No. Coma/576 dated 26.08.2015, under Section 138 of Negotiable Instruments Act, 1881 (hereinafter referred to as "the Act") pending in the Court of learned Sub Divisional Judicial Magistrate, Rajpura.

Petitioner, who is facing trial before the learned Judicial Magistrate in a case filed on the basis of complaint under Section 138 of the Act, was declared proclaimed absconder on 03.01.2018. As such, petitioner is not entitled to pre-arrest bail. Hence, present petition stands dismissed. However, in case petitioner surrenders before the learned trial Court within a period of two weeks from today and if any application for grant of bail is filed, the same shall be decided expeditiously and preferably within a period of one week thereafter.
