1. The petitioner seeks grant of anticipatory bail in a case registered vide FIR No.166 dated 19.7.2021 under Sections 323/325/506/34 IPC at Police Station Tigaon, District Faridabad.

2. Learned counsel for the petitioner submits that it is only the offence under Section 506 IPC which is non-bailable and which has been added simply in order to harass the petitioner. It has further been submitted that even as per the FIR, it is the co-accused Aajipal who is alleged to have given a blow with iron rod on the head of Subhash, which has been opined to be a grievous injury and that the role attributed to the petitioner is that he had inflicted a blow with 'danda' to the complainant on his right hand and right leg.

3. The aforestated position regarding the role of the petitioner is not disputed by learned State counsel. Learned State counsel has informed that the petitioner is not involved in any other case.

4. Having regard to the aforestated factual position, wherein the petitioner is attributed a simple injury on foot and hand of the complainant and the grievous injury is attributed to the co-accused (non-applicant), the petition is accepted and it is ordered that the petitioner in the event of his arrest shall be released on anticipatory bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 10.8.2021 (Gurvinder Singh Gill) kamal Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No
