RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.330 dated 10.08.2017 registered under Sections 148, 149, 307, 452, 506, 201 IPC and Section 27 of the Arms Act, 1959 at Police Station Safidon, District Jind.

Petitioner is facing trial in the aforesaid FIR on the allegations that in the morning of 10.08.2017, he entered the house of the complainant and fired two shots from his gun with the intention to kill the complainant, who escaped narrowly.

Learned counsel for the petitioner inter alia contends that during investigation petitioner was declared innocent. However, he was arrested on the directions of a Co-ordinate Bench of this Court dated 15.12.2017, while hearing bail application bearing number CRM-M-47142 of 2017 of co-accused namely, Naresh Kumar @ Neshi. -2CRM-M-53093 of 2018 alleged eye-witnesses have turned hostile. Petitioner is in custody since 10.05.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
