Present petition is challenge to the impugned order dated 18.5.2009, passed by Chief Judicial Magistrate, Nawanshahr, whereby petitioner was declared Proclaimed Offender as he failed to put in appearance before the learned trial Court despite issuance of warrants of arrest and notice of proclamation, as required under law. Learned counsel for the petitioner fairly conceded at the time of arguments that petitioner did not put in appearance before the learned trial Court and as such he was declared Proclaimed Offender. That may be a case with the petitioner but this was not a ground for remaining away from the Court for pretty long period. He was required to put in appearance before the learned trial Court during the course of trial. Learned counsel also contended that present institution of case against him lacks territorial jurisdiction. Petitioner is at liberty to challenge the same by taking appropriate remedy as available to him under law, but as Deepak Kumar Bhardwaj 2017.03.30 14:46 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-7018 of 2017 such this is not a ground to set aside the impugned order. In view of above, present petition is without any merit and the same stands dismissed.
