Rajan Gupta, J (Oral) Learned State counsel as well as counsel for respondent Nos. 3 & 4 at the outset have raised a preliminary objection that petitioner has alternate remedy of filing a revision petition before the Financial Commissioner.

After arguing at some length, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to prefer a revision before the revisional authority. Dismissed as withdrawn with aforesaid liberty. In case, question of limitation arises, petitioner shall be at liberty to take the plea that he was pursuing his remedy before another forum.
