(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.52 dated 10.05.2020 under Sections 323, 324, 506, 148 and 149 IPC (Section 326 IPC added later on) registered at Police Station Chabbewal, District Hoshiarpur, who is in custody since 17.06.2020. Counsel for the petitioner herein would contend that it is a case of version and cross version as the co-accused Harinder Singh was also injured and he lodged DDR No.18 dated 12.05.2020 against the complainant and his brother. The co-accused Harinder Singh has already been granted bail by this Hon'ble Court vide order dated 14.08.2020 passed in CRM-M No.18835 of 2020. Challan has already been presented and therefore, the petitioner is entitled to concession of bail. Learned counsel appearing for the respondent-State opposes the bail application by submitting that no ground is made out for grant of bail to the petitioner.

CRM-M No.25732 of 2020 (O&M) -2I have heard learned counsel for the parties. Keeping in view the fact that the challan has already been presented and the co-accused has already been granted regular bail by this Court coupled with the fact that the trial is likely to take some time to conclude due to COVID-19 situation, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
