Status report has been filed by respondent-State. In terms of the contents thereof, it is argued by learned State counsel that there are serious and specific allegations against the petitioner, who brutally murdered the victim by causing several injuries on his person and caused disappearance of evidence of the offence by throwing the dead body of the victim on a side of the road. The material witnesses are yet to be examined. There are chances of petitioner's absconding on intimidating the witnesses, if extended of benefit of bail. Therefore, it is urged that petition does not deserve to be allowed.

The petitioner is alleged to have committed the murder of the victim and is further alleged to have caused disappearance of evidence of offence committed by him. The fact that he had not been named in the FIR, is not a circumstance which entitles the petitioner to be extended benefit of bail. The material witnesses are yet to be examined. There is, however, nothing on record to show that there would be any undue delay in conclusion of the trial. The gravity of the allegations is an important factor for considering grant of benefit of bail to an accused. Keeping in view the grave nature of the allegations as levelled against the petitioner, the quantum of sentence which the conviction may entail and the attendant facts and circumstances of the case 3
