The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.0658 dated 11.11.2025 (Annexure P-1) registered under Sections 316(2), 316(5), 318(4), 338, 336(3), 340(2), 61, 3(5), 344 of BNS and Section 7, 12 and 13(2) of Prevention of Corruption Act at Police Station Assandh, District Karnal. 2.

As per the allegations, Shree Radhe Radhe Rice Mills defalcated paddy to the extent of more than four crores. The petitioner is stated to be Secretary, Market Committee, Assandh.

The learned Senior counsel for the petitioner contends that the main accused namely Tarsem Kumar @ Tarsem Lal Garg has undertaken to make good the entire loss. In furtherance of the same, a sum of

-2Rs.3,00,00,000/- has been paid and Rs.1,78,59,726.1/- would be paid shortly. As the petitioner is in custody since 17.02.2026 but the challan has not yet been submitted, therefore, the trial of the present case is not likely to be concluded anytime soon. Hence, he be granted the concession of bail moreso when co-accused namely Parmod Kumar and Darshan Singh have been granted the concession of bail vide order dated 24.04.2026. 3.

The learned State counsel has not disputed the factual assertions that the main accused namely Tarsem Kumar @ Tarsem Lal Garg has undertaken to make good the entire loss, and in furtherance thereof, a sum of Rs.3,00,00,000/- already stands paid towards dues of HAFED. He also concedes that the petitioner is in custody since 17.02.2026 but the challan has not yet been submitted.

I have heard the learned counsel for the parties. 5.

Admittedly, Tarsem Kumar @ Tarsem Lal Garg, the proprietor of Shree Radhe Radhe Rice Mills has undertaken to make good the entire loss suffered by HAFED in furtherance of which he has paid a sum of Rs.3,00,00,000/- as against total outstanding amount of Rs.4,78,59,726.13/-. He has been granted the concession of interim anticipatory bail. The petitioner, who is Secretary, Market Committee, Assandh, has been in custody since 17.02.2026 but the challan has not yet been submitted. Therefore, the Trial of the present case is not likely to be concluded in the near future. In this situation the further incarceration of the petitioner is not

-3required moreso when co-accused namely Parmod Kumar and Darshan Singh have been granted the concession of bail vide order dated 24.04.2026. 6.

Thus without commenting on the merits of the case, the present petition is allowed and petitioner Krishan Dhanker S/o Sant Kumar is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.

The petition stands disposed of.
