Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.153 dated 03.09.2016 under Section 22 of the NDPS Act and under Section 61 of the Punjab Excise Act registered at Police Station City Sri Muktsar Sahib, District Sri Muktsar Sahib. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per prosecution version, on 03.09.2016 police party apprehended the petitioner and recovered 15 bottles of Corex containing Codine and 1200 tablets of alprazolem. CRM No.M-7091 of 2017 -2under commercial quantity and Section 37 of the NDPS Act bars the grant of bail in case of commercial quantity.

Learned counsel for the petitioner argued that petitioner has been falsely implicated and representation has also been made to make enquiry in the present case as the brother of the petitioner was murdered by accused persons in connivance with the police and therefore, the present petitioner has been falsely implicated.

At this stage, there is no document or enquiry report to support the averments of counsel for the petitioner. The representation was given after registration of the FIR.

Keeping in view the facts and circumstances of the present case and in view of the recovery from the petitioner, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
