Learned counsel has filed vakalatnama on behalf of the complainant on his own though he has not been impleaded as party. The same is taken on record.

Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.67 dated 01.04.2019 registered under Sections 307, 34 IPC at Police Station City Ferozepur, District Ferozepur.

According to the prosecution, in the day time of 31.03.2019, petitioner while driving his three-wheeler applied sudden breaks in front of horse-cart of the complainant. However, with the good sense of the complainant, accident averted as he overtook three-wheeler of the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
