CRR No.2825 of 2015, --2-- CRR No.2940 of 2015 and CRR No.3323 of 2015 additional accused to face trial under Section 306/34 IPC. At the very outset, learned counsel for the petitioner(s) producing photocopy of judgment dated 09.04.2018 of trial court, duly attested by him, contends that main accused Parveen Kumar has been acquitted by the trial court vide aforesaid judgment. Therefore, no useful purpose would be served by separate trial of the petitioners, who were not challaned by the police and were summoned as additional accused upon the application of the complainant under Section 319 Cr.P.C. Learned State counsel does not controvert the above submissions of learned counsel for the petitioner(s).
In view of the above factual aspect, the instant petition and other connected petitions are accepted.
