Petitioner is alleged to be the second wife of the complainant's husband. She seeks the concession of anticipatory bail in FIR No.272 dated 13.12.2016 under Sections 498A/406/494/420/177/120B IPC (the offences punishable under Sections 467/468/471 IPC added later) registered at Police Station City Kapurthala, District Kapurthala. It is submitted that the petitioner herself is a victim at the hands of the complainant's husband in this case. She has been duped into marriage by the complainant's husband. The petitioner was not aware of the first marriage of Tarshinder Singh i.e., the husband of the complainant. CRM No.M-7124 of 2017 [2] investigation pursuant to order dated 02.03.2017. Therefore, this petition be allowed.
Learned counsel for the State, on instructions from ASI Satnam Singh, submits that the petitioner has joined investigation. It is however submitted that an Adhaar Card of the petitioner is yet to be recovered though this is refuted by learned counsel for the petitioner. However, it is submitted that the petitioner undertakes to handover the Adhaar Card/copy thereof to the Investigating Agency on 23.05.2017 at 11.00 a.m. There are no allegations on behalf of the State that the petitioner is likely to abscond or that she is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 02.03.2017 is made absolute. It is clarified that none of the observations made hereinabove shall be construed to be a reflection on the merits of the case. The same are solely confined for the purpose of decision of the present petition. ( LISA GILL ) May 17 , 2017.
