The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondents to register sale deed in execution of judgment and decree dated 25.05.2012 in favour of the petitioner and co-decree holder Lakmi Chand (since deceased). 2.

The petitioner along with one Lakmi Chand (since deceased) through his LRs filed a civil suit for specific performance of contract which was decreed vide judgment and decree dated 25.05.2012. He along with his co-decree holder filed an execution petition whereby vide order dated 20.12.2022 Court appointed its Reader as Local Commissioner to execute sale deed in favour of decree holders. Sub Registrar, Kaithal on 02.08.2024 appeared before learned Executing Court and informed that matter has been SUDEEPAK KUMAR 2026.04.24 15:51 I attest to the accuracy and integrity of this document

-2referred to Deputy Commissioner seeking permission for manual registration. By order dated 02.08.2024, learned Executing Court asked Sub Registrar to furnish detailed report. Learned Court vide order dated 03.07.2025 directed Sub Registrar to submit report on issues raised in the order. The Court vide order dated 16.09.2025 disposed of execution petition with liberty to decree-holders to file fresh execution in case other formalities under applicable Rules and instructions are complied with. 3.

Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to avail alternative remedies as permissibly by law. 4.

Dismissed as withdrawn with aforesaid liberty. 5.
