(Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for setting-aside the impugned order dated 09.02.2023 (Annexure P-5) passed by respondent No.3. Mr. Ashwani Prashar, Advocate, who has caused appearance on behalf of respondent No.4 on the last date of hearing, submits that he has no instructions from respondent No.4. Learned counsel for the petitioner has produced a copy of the settlement dated 10.12.2024 whereby the matter has been settled between the petitioner and respondent No.4 for the release of retiral benefits. Out of the balance amount of Rs.3,14,526/-, a sum of Rs.1,00,000/- has been paid and the remaining amount shall be paid to MOHD YAKUB 2024.12.12 17:37 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh
CWP-12009-2024 the petitioner by 31.03.2025 and the petitioner has also undertaken to withdraw the present petition. The same is taken on record. In view of the settlement, the present petition is disposed of. The parties shall be bound by the terms and conditions set out in the settlement.
Liberty is also granted to the petitioner to revive the present petition in case the balance payment of Rs.2,14,526/- is not released by respondent No.4 by 31.03.2025.
