Mr.Raj Kumar Kakkar, Advocate for the petitioner. ***** SANJEEV PRAKASH SHARMA, J (ORAL) The present petition has been filed for assailing the impugned order dated 20.03.2023, passed by the court of learned Principal Judge, Family Court, Ferozepur.

Admittedly as it has come on record by recording evidence that the petitioner's income is above Rs.1.50 lac and he owns several properties also. However, learned counsel for the petitioner submits that the petitioner does not get the entire salary in hand, moreover he has to pay loans for the flat which he has purchased of Rs.58.00 lacs. I have considered the submissions made by the counsel for the petitioner and it has also come on record that there is another flat in the joint name of the petitioner and his wife but his wife is not allowed to stay in the said house and is forced to live in her parental home with her child. Keeping in view that she is not earning although she may be well qualified, the grant of maintenance of a sum of Rs.40,000/- per month to her and to her son as an ad-interim maintenance cannot be said to be on the higher side.
