This writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 23.01.2023 (Annexure P-1) whereby the petitioner has been suspended from the post of Sarpanch. 2.

Learned counsel for the petitioner has submitted that against order dated 23.01.2023 (Annexure P.1), the petitioner has filed an appeal along with an application seeking stay and on 24.02.2023, notice had been issued by respondent No.1 to the complainant for 06.04.2023 and respondent No.1 had also observed that the stay application would also be heard on the date fixed i.e 06.04.2023. It is submitted that thereafter the matter has been adjourned repeatedly and has not been taken up for arguments with the same having now been fixed for 15.06.2023. He further submits that the petitioner would be satisfied in case, respondent No.1 is directed to decide Appeal No.34 of 2023 on 15.06.2023 or within a period of one month thereafter. 3.

Learned State Counsel has submitted that every endeavour would be made by respondent No.1 to decide the appeal as expeditiously as possible or in any case within a period of one month from 15.06.2023. MANOJ KUMAR 2023.05.29 09:02 I attest to the accuracy and integrity of this document

Keeping in view the abovesaid facts and circumstances, the present Civil Writ Petition is disposed of with a direction to respondent No.1 to decide Appeal No.34 of 2023 on 15.06.2023 or within a period of one month from 15.06.2023.

It is made clear that this Court has not opined on the merits of the case and respondent No.1 would consider and decide the matter independently, in accordance with law.
