HARINDER SINGH SIDHU, J Prayer for grant of regular bail in case FIR No. 179 dated 18.08.2020, registered under Sections 20, 27-A of NDPS Act, at Police Station Julana, District Jind.
Allegations in the FIR are that on the basis of secret information, 270 Ganja Patti, were recovered from co-accused Bholu and Ajay. The name of the petitioner is alleged to have surfaced in the disclosure statement of co-accused Ajay who stated that out of the total contraband recovered, 100 Kg of Ganja Patti, belonged to the petitioner and the petitioner had paid him Rs. 1 lac for purchasing the same. Learned counsel for the petitioner submits that the petitioner was arrested on 24.02.2021. No recovery has been effected from the petitioner. The investigation in the case is complete. Though there are 15 other criminal cases registered against the petitioner, however, he has been acquitted in 13 cases, one case is pending trial and in another case registered under the provisions of NDPS Act, he has been convicted and that his MANOJ KUMAR 2022.03.17 19:33 I attest to the accuracy and integrity of this document

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial of the case is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Rajender @ Shalu is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly. However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found involved misusing the concession of bail, in any manner or is involved in any other case of similar nature.
