NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for setting-aside the order dated 21.12.2023 (Annexure P-6), passed by respondent No.2, whereby it has been ordered that petitioner be given pension and retirement benefits for the post of Clerk despite the fact that he has retired as Junior Engineer. Further a writ of mandamus has been sought for directing the respondents to calculate and release pension and retirement benefits to the petitioner as applicable to the post of Junior Engineer, along with interest @ 18% per annum on delayed payments. After arguing the case for some time, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file afresh one, on the same cause of action, with better particulars by attaching correct copy of the translated documents.
