MEENAKSHI I. MEHTA (ORAL) Case has been taken up through video conferencing in view of the outbreak of Pandemic COVID-19.

By way of the instant petition, the petitioner has sought the relief of issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to protect his life and liberty as he apprehends threat to the same at the hands of respondents No.4 and 5. A further prayer has also been made for issuance of direction to these respondents not to harass or falsely implicate him in any criminal case. It has also been mentioned in the petition that the petitioner has already moved a representation (Annexure P-4) to respondents No.2 and 3 in this regard.

Learned counsel for the petitioner restricts his prayer to issuance of a direction to respondent No.3 to take appropriate action on the said representation (Annexure P-4).

Learned counsel for the State has no objection for the same. Undisputedly, the protection of life and liberty is a fundamental right of every citizen as enshrined in Article 21 of the Constitution of India. Therefore, respondent No.3-Senior Superintendent of Police, FatehgarhSahib, is hereby directed to look into and decide the said representation (Annexure P-4) in accordance with law. However, it is clarified that this order shall not be construed to be a shield to the petitioner against any proceedings initiated by the competent Authority/person on account of the facts and circumstances, as narrated in representation Annexure P-4 and permissible under any relevant provisions of law. This petition stands disposed of.
